What joy could we have in killing the sons of Dhritarashtra, Janardana? Though they are aggressors, only sin would cling to us for killing them.
Context and commentary on verse 1.36
The word atatayin has a precise meaning in dharmashastra. According to the smriti verse Sridhara Swami quotes, six kinds of men are atatayins: one who sets fire to a house, one who gives poison, one who comes weapon in hand to kill, one who plunders wealth, one who seizes land, and one who carries off another’s wife. Many list how Duryodhana had done all of these: the fire in the house of lac, poison for Bhima, the seizing of the kingdom, the humiliation of Draupadi. There is also a saying that there is no fault in killing an atatayin.
Why sin, then? Sridhara’s answer is subtle. That an atatayin may be killed is a rule of arthashastra, the science of statecraft. That teachers and kinsmen must not be killed is a rule of dharmashastra. He cites the Yajnavalkya Smriti for the principle that when two smritis conflict, dharmashastra is the stronger. Besides, Swami Sivananda explains Janardana as the one to whom people pray for prosperity and liberation.

Not everything the law permits need be acceptable to conscience. I have the right is the answer to one question. Should I do this is a different question.
In medicine this gap is seen every day. Whether a treatment the rules allow is right for this patient, at this stage, remains a question. But there is another side too. Sitting still and doing nothing when caught between two rules is also a decision. The Gita examines that side as well, later on.
